BHPB online store – Terms of Service

§1. General provisions

  1. The BHPB online store (the “Store”) is run by a natural person as an unregistered activity (działalność nierejestrowana) under Polish law; their details (name, address, email) are available under Contact information (the “Seller”).
  2. These Terms set out the rules for using the Store, placing orders, concluding sales contracts, delivery, payment, withdrawal from the contract and complaints.
  3. Definitions: Consumer – a natural person buying for purposes unrelated to their business or profession; Entrepreneur with consumer rights – a natural person running a sole proprietorship for whom the purchase is not of a professional nature (based on the Polish CEIDG business register); Buyer – anyone placing an order; Business days – Monday to Friday excluding public holidays.
  4. To use the Store you need a device with internet access, an up-to-date browser with cookies and JavaScript enabled, and an email address.

§2. Product and price information

  1. Product information in the Store is not an offer within the meaning of the Polish Civil Code but an invitation to conclude a contract.
  2. Prices are gross prices in Polish zloty (or in the currency chosen by the Buyer) and are final prices for orders to Poland. Standard delivery is free.
  3. When a price is reduced, the Store shows the lowest price of the product from the 30 days before the reduction.
  4. Promotions and discount codes have their own terms, cannot be combined unless their terms say otherwise, and one code can be used per order.
  5. Product photos are illustrative; colours on screen may differ slightly from reality depending on your device settings. Photos in banners and photo sessions may be digitally edited.
  6. Products marked “coming soon” cannot be purchased.

§3. Orders and conclusion of the contract

  1. You place an order by adding products to the cart, entering delivery and contact details, choosing a payment method and confirming the order with a button that involves an obligation to pay. Placing an order constitutes the Buyer's offer.
  2. The automatic email sent after placing an order confirms that it was received. The sales contract is concluded when the Buyer receives an email confirming that the order has been accepted for fulfilment or an email with shipping information – whichever comes first.
  3. If the Seller does not accept the order within 3 business days (e.g. because the product is unavailable or there is an obvious error in the price or description), the Buyer's offer expires and the Seller refunds the full amount paid without delay, no later than within 3 business days, using the same payment method.
  4. The Buyer provides true and up-to-date details. The content of the contract (order, terms) is recorded and sent to the Buyer by email.

§4. Payments and sales documents

  1. Available payment methods are shown at checkout (including payment cards, Apple Pay, Google Pay, Shop Pay, PayPal – depending on availability). Payment is made in advance.
  2. Payments are handled by external operators; the Seller has no access to payment card data.
  3. The Seller runs an unregistered activity and does not issue VAT invoices. At the Buyer's request, the Seller issues a receipt (rachunek).

§5. Delivery

Delivery rules and times are described in the Shipping policy, which forms part of these Terms.

§6. Withdrawal from the contract

A Consumer and an Entrepreneur with consumer rights may withdraw from the contract within 14 days of receiving the goods without giving a reason. Details and a model form are in the Refund policy, which forms part of these Terms. The direct cost of returning the goods is borne by the Buyer.

§7. Complaints

  1. The Seller is liable to the Consumer and the Entrepreneur with consumer rights for the conformity of the goods with the contract under the Polish Consumer Rights Act and Civil Code, for 2 years from delivery.
  2. Complaints can be submitted by email, stating the order number, a description of the problem, your request and – if possible – photos. The Seller responds within 14 days of receipt.
  3. Normal wear, mechanical damage caused by the user and the effects of improper care (contrary to the instructions on the label or in the product description) do not constitute non-conformity of the goods with the contract.

§8. Electronic services

  1. The Seller provides the following services free of charge: newsletter, contact form and customer account. The service contract is concluded upon signing up or creating an account; the Buyer may terminate it at any time (link in the newsletter, deleting the account or an email to the Seller).
  2. The Buyer may not provide unlawful content.
  3. Complaints about electronic services can be submitted by email – the Seller handles them within 14 days.

§9. Copyright

Photos, descriptions, the BHPB logo and the Store's graphic layout are protected by copyright. Copying and using them, including for commercial purposes (e.g. in sales listings), without the Seller's consent is prohibited.

§10. Buyers who are not consumers

In relation to Buyers who are neither Consumers nor Entrepreneurs with consumer rights: the Seller's liability under statutory warranty is excluded; the risk of loss of or damage to the goods passes to the Buyer when the goods are handed over to the carrier; the Seller's liability is limited to the order value and does not cover lost profits; the competent court is the court having jurisdiction over the Seller's place of residence.

§11. Personal data

The rules for processing personal data are described in the Privacy policy.

§12. Out-of-court dispute resolution

Consumers may seek help from consumer ombudsmen, consumer organisations or the Trade Inspection authorities in Poland (information on the UOKiK website), as well as from consumer protection bodies in their own country.

§13. Final provisions

  1. Matters not covered by these Terms are governed by Polish law, in particular the Civil Code and the Consumer Rights Act. The choice of Polish law does not deprive a Consumer of the protection granted by the mandatory provisions of the law of their country of habitual residence. These Terms do not limit Consumers' statutory rights.
  2. The Seller may amend these Terms for important reasons (changes in law, payment or delivery methods, or the scope of services). Changes do not apply to orders placed before they take effect; newsletter subscribers and account holders will be notified 14 days in advance.

This is a translation for convenience. In case of any discrepancy, the Polish version prevails; it never limits the rights you have as a consumer under the law of your country of residence.
